How do I qualify for social security disability benefits?

In New Jersey, the process for obtaining Social Security Disability (SSD) and/or Supplemental Security Income (SSI) benefits is complicated and technical. Most people who file an application on their own are turned down because they fail to adequately demonstrate that their disabling condition is preventing them from working. Many people also make procedural errors because they are unfamiliar with navigating a complicated system. Without an attorney, the risk of denial or long delays in approval is increased. Am I eligible for disability benefits?

In order to be eligible for Social Security disability benefits you either have to have stopped working or reduced your work activity to below substantial gainful activity. In addition, you must be able to show that you have:

  • Suffered a serious injury or illness recognized on the list of recognized impairments (see above)
  • You are not able to work as a result of your illness or injury
  • Said injury or illness is expected to last at least one year or result in death
  • You are not able to perform past work or other types of work as a direct result of your injury or illness

It is important to note that you can apply for benefits the moment you become unable to work and do not have to wait for 12 months to apply. Can I appeal a social security disability denial?

Denied benefit claims are not the end of the road, there is a lot we can do! Many of our clients were denied their initial claim for Social Security benefits. How the Application Process Works
